Effective date: July 21, 2026

These Terms and Conditions (“Terms”) form a legally binding agreement between HomeTunnel Inc. (“HomeTunnel,” “we,” “us,” or “our”) and the person or organization that accesses or uses the Services.

Read these Terms before creating an account, starting a trial, purchasing a subscription, installing HomeTunnel software, pairing a device, or using the Services.

3. Acceptance of these Terms

You agree to these Terms by:

  • creating an account;
  • affirmatively accepting them;
  • starting a trial;
  • purchasing a subscription;
  • installing or using HomeTunnel software;
  • pairing or enrolling a device; or

4. Eligibility and age requirements

You must be at least 16 years old to use the Services.

If you are 16 or 17, or have not reached the age of majority where you live:

  • a parent or legal guardian must review and accept these Terms;
  • your parent or legal guardian must authorize your use;
  • your parent or legal guardian must control or authorize any paid subscription; and
  • your use must otherwise be permitted by applicable law.

You must also:

  • have legal capacity to enter the applicable agreement;
  • provide accurate account and billing information;
  • be legally permitted to use the Services where you live;
  • be legally permitted to manage each connected home, property, network, and device; and
  • not be prohibited from using the Services under sanctions, export-control, or other applicable laws.

5. Geographic availability

The Services are currently offered in the United States and Canada, excluding Quebec.

The Services are currently provided in English. HomeTunnel does not currently offer the Services for purchase in Quebec.

HomeTunnel may expand, limit, suspend, or discontinue availability in a jurisdiction for legal, language, security, provider, operational, or commercial reasons.

The fact that a website is accessible from a location does not mean HomeTunnel offers the Services there.

6. Accounts

You must provide accurate information and keep it current.

You are responsible for activity carried out through your account, except to the extent caused by HomeTunnel’s failure to meet a legal obligation that cannot be excluded.

You must:

  • protect your Microsoft account, email account, authentication factors, and recovery methods;
  • use strong and unique credentials;
  • prevent unauthorized access to your devices;
  • promptly report suspected account compromise;
  • promptly revoke devices that are lost, sold, transferred, or compromised; and
  • not share an account in a way that bypasses subscription, ownership, or security controls.

HomeTunnel may rely on validated account identity and authorization records when processing requests.

7. Authority over homes, networks, and devices

You may connect, access, configure, monitor, or manage only:

  • homes you own;
  • properties you are authorized to administer;
  • networks you are authorized to access;
  • Home Assistant installations you are authorized to manage;
  • devices you own or are authorized to manage; and
  • private services that you are legally permitted to access.

You are responsible for obtaining any required authorization from:

  • property owners;
  • residents;
  • tenants;
  • household members;
  • employers;
  • customers;
  • contractors;
  • guests; and
  • other affected people.

HomeTunnel does not grant you authority over a property, network, device, or service that you would not otherwise have.

8. Service description

HomeTunnel is a remote-access and management service for explicitly authorized private services.

HomeTunnel uses:

  • a HomeTunnel-operated control plane;
  • authenticated account and ownership controls;
  • NetBird’s WireGuard-based connectivity components;
  • automated access-control policies;
  • per-home isolation;
  • narrowly scoped routes; and
  • direct peer-to-peer connectivity where available, with encrypted relay fallback when necessary.

HomeTunnel is not intended to operate as a traditional full-tunnel consumer VPN. It does not expose an entire home LAN by default.

Home Assistant access and other configured services are intended to be limited to explicit host addresses and ports authorized through the HomeTunnel control plane.

9. Service dependencies and limitations

The Services depend on systems outside HomeTunnel’s complete control, including:

  • your devices;
  • your Home Assistant installation;
  • local networking equipment;
  • internet service;
  • mobile or fixed-network providers;
  • electricity;
  • firewalls;
  • routers;
  • NAT and carrier-grade NAT;
  • domain-name services;
  • operating systems;
  • Microsoft Entra;
  • NetBird;
  • Paddle;
  • Cloudflare;
  • hosting providers;
  • device manufacturers; and
  • other third-party services.

HomeTunnel does not guarantee:

  • uninterrupted operation;
  • error-free operation;
  • direct peer-to-peer connectivity;
  • avoidance of relay connectivity;
  • compatibility with every router, network, device, operating system, or Home Assistant configuration;
  • uninterrupted access during a device move or route update;
  • access during internet, power, provider, or equipment outages;
  • support for every third-party integration;
  • native HomeKit, Matter, Thread, Google Cast, or AirPlay remote discovery;
  • access to an entire private LAN; or
  • prevention of every security incident, misconfiguration, or unauthorized act.

10. Not an emergency, alarm, or safety service

HomeTunnel is not:

  • an emergency service;
  • a monitored alarm service;
  • a medical-monitoring service;
  • a fire-monitoring service;
  • a security-monitoring guarantee;
  • an access-control guarantee;
  • a utility-control guarantee;
  • a life-safety service; or
  • a substitute for local access and manufacturer safety mechanisms.

Do not rely on HomeTunnel as the sole method of operating, monitoring, or controlling:

  • locks;
  • alarms;
  • heating or cooling;
  • electrical systems;
  • water systems;
  • fire systems;
  • medical equipment;
  • security equipment;
  • access-control systems;
  • critical automations; or
  • anything whose failure could cause injury, death, major property damage, or serious financial loss.

Maintain appropriate:

  • local controls;
  • physical access;
  • backups;
  • alarms;
  • emergency procedures;
  • safety systems;
  • manufacturer safeguards; and
  • alternate communication or control methods.

11. Your security responsibilities

You are responsible for:

  • securing your Microsoft account and email account;
  • protecting authentication methods and recovery information;
  • securing devices on which HomeTunnel is installed;
  • protecting pairing codes and enrollment information;
  • keeping software and operating systems updated;
  • preventing malware and unauthorized access;
  • reviewing enrolled devices;
  • revoking devices that should no longer have access;
  • configuring routes and target services accurately;
  • ensuring configured services are authorized and safe;
  • securing your Home Assistant account and installation;
  • securing the local network;
  • reviewing notification and status information;
  • maintaining backups; and
  • reporting suspected compromise promptly.

Signing out of a control-plane account may not revoke a previously enrolled device at the network layer.

When access must end, use the applicable device-removal, revocation, or deletion process.

12. Acceptable use

You must not use, attempt to use, or assist another person in using the Services to:

  • access a system, network, home, property, account, or device without authorization;
  • monitor another person unlawfully;
  • violate privacy, surveillance, computer-misuse, cybersecurity, telecommunications, sanctions, export, or other laws;
  • distribute malware;
  • steal or capture credentials;
  • conduct phishing or social-engineering attacks;
  • interfere with the Services;
  • overload, disrupt, probe, scan, or test systems without authorization;
  • bypass authentication or authorization;
  • bypass route scope;
  • bypass home isolation;
  • bypass plan or quota limits;
  • bypass subscription restrictions;
  • obtain HomeTunnel or NetBird administrative credentials;
  • impersonate another person or organization;
  • provide false ownership or authorization information;
  • conceal an unauthorized device;
  • resell or sublicense the Services without written authorization;
  • use the Services to infringe intellectual-property rights;
  • use the Services in a manner likely to harm HomeTunnel, its providers, users, or third parties; or
  • encourage or facilitate prohibited conduct.

Authorized security testing requires HomeTunnel’s prior written permission unless a separately published vulnerability-disclosure policy expressly permits the activity.

13. Plans and feature limits

Available plans, prices, billing periods, limits, and features are shown on the website and at checkout.

Plan limits may include:

  • number of homes;
  • number or type of devices;
  • network routes per home;
  • available management capabilities;
  • diagnostics;
  • notifications; and
  • other plan-specific features.

Plan enforcement occurs on HomeTunnel’s servers. Client-side displays are informational and are not authoritative.

HomeTunnel may prevent or restrict an operation that would exceed the applicable plan.

HomeTunnel will not intentionally delete account configuration solely because a subscription expires or a plan is downgraded. HomeTunnel may instead restrict homes, devices, routes, or distribution until the account regains an eligible subscription or is brought within the applicable limit.

14. Trials

An eligible monthly subscription may include a 14-day trial.

Unless checkout expressly states otherwise:

  • payment information is required to start the trial;
  • only one trial is permitted per HomeTunnel account;
  • annual subscriptions do not include a trial;
  • the trial begins when indicated at checkout;
  • the trial automatically converts into the selected paid monthly subscription unless cancelled before the trial expires; and
  • the subscription then automatically renews until cancelled.

Trial eligibility is determined by HomeTunnel’s server-side records. Creating another email address, identity, or account to obtain additional trials is prohibited.

The checkout page controls if its trial disclosure differs from general website descriptions.

15. Website-only purchases

HomeTunnel subscriptions are currently purchased through the HomeTunnel website.

HomeTunnel does not currently accept subscription purchases through Apple App Store or Google Play billing.

Future mobile applications may permit users to access an existing HomeTunnel account. Separate app-specific policies or store disclosures may apply when those applications are released.

16. Paddle as merchant of record

Paddle acts as merchant of record for eligible HomeTunnel purchases.

This means Paddle may act as the seller of record for the transaction and may handle:

  • checkout;
  • payment processing;
  • payment methods;
  • currency conversion;
  • taxes;
  • invoices and receipts;
  • fraud screening;
  • payment disputes;
  • chargebacks;
  • refunds; and
  • buyer payment support.

The customer may be required to accept Paddle’s buyer terms, refund policy, and privacy notice during checkout.

HomeTunnel remains responsible for providing and supporting the HomeTunnel service, subject to these Terms.

17. Prices, taxes, and currency

The price, currency, billing period, applicable taxes, and other transaction information will be displayed at or before checkout.

Taxes may depend on your billing location and applicable law.

You authorize Paddle or the applicable payment provider to charge the displayed amount using your selected payment method.

You must provide accurate billing and tax information.

HomeTunnel does not control:

  • exchange rates set by banks or payment networks;
  • foreign-transaction fees;
  • card-provider charges; or
  • other charges independently imposed by your financial institution.

18. Automatic renewal

Subscriptions automatically renew for the billing period selected at checkout unless they are cancelled before the next renewal is processed.

A monthly subscription renews monthly.

An annual subscription renews annually.

By purchasing a recurring subscription, you authorize the applicable merchant of record or payment provider to charge the recurring price, applicable taxes, and any properly disclosed price change using the stored payment method.

HomeTunnel will provide notice of material price changes as required by applicable law.

19. Cancellation

You may cancel through:

  • the HomeTunnel billing page;
  • the Paddle customer or buyer portal, where available; or
  • another cancellation method identified by HomeTunnel.

Unless mandatory law, checkout, or the Refund Policy states otherwise:

  • cancellation prevents the next renewal;
  • cancellation takes effect at the end of the current paid period;
  • access continues until the applicable period end;
  • no partial-period credit is automatically created; and
  • cancellation does not automatically delete the HomeTunnel account or configuration.

Cancelling during an eligible trial prevents conversion to a paid subscription if the cancellation is completed before the trial expires.

20. Refunds

HomeTunnel’s Refund Policy is available at:

https://hometunnel.io/refundpolicy/

The Refund Policy is incorporated into these Terms by reference.

Refunds may also be governed by:

  • Paddle’s refund policy;
  • Paddle’s buyer terms;
  • the transaction information shown during checkout; and
  • mandatory consumer-protection law.

Where Paddle acts as merchant of record, refund requests may be processed by Paddle.

Nothing in these Terms removes a refund, withdrawal, cancellation, or other consumer remedy that cannot legally be excluded.

21. Payment failure, disputes, and fraud

HomeTunnel may restrict or suspend paid functionality if a subscription becomes:

  • unpaid;
  • past due;
  • paused;
  • expired;
  • cancelled after the access period;
  • reversed;
  • refunded;
  • disputed;
  • associated with fraud; or
  • otherwise ineligible for paid access.

HomeTunnel’s current service policy may temporarily retain access during certain past-due states. This does not waive payment obligations or guarantee continued access.

A chargeback or payment dispute does not automatically cancel your underlying HomeTunnel account. It may result in subscription restriction, investigation, or suspension.

22. Subscription expiration and restrictions

When paid entitlement ends, HomeTunnel may:

  • stop route distribution;
  • restrict homes;
  • restrict devices;
  • restrict custom routes;
  • block new enrollment;
  • block new resource creation;
  • preserve configuration for possible reactivation; and
  • reconcile HomeTunnel and NetBird access state.

HomeTunnel is not required to maintain inactive configuration indefinitely.

23. Inactive accounts

An account may be designated inactive after all of the following have occurred for 12 consecutive months:

  • there is no active or trial subscription;
  • there has been no portal sign-in; and
  • there has been no authenticated device heartbeat.

HomeTunnel intends to provide at least 30 days’ notice to the account email address before scheduled inactive-account deletion.

Signing in or reactivating service before the scheduled deletion date cancels the scheduled deletion.

Account configuration will generally be removed from active systems within 30 days after the scheduled deletion date. Deleted information will expire from ordinary rolling backups within approximately 35 additional days, subject to legal holds, security incidents, disaster recovery, and legally required retention.

24. User-requested account deletion

You may request account deletion by contacting support@hometunnel.io from the email address associated with the account.

HomeTunnel may require identity and ownership verification.

Account deletion may require HomeTunnel to:

  • terminate active access;
  • revoke device credentials;
  • remove route distribution;
  • remove or disable NetBird peers and resources;
  • clean up associated account configuration;
  • preserve financial records required by law; and
  • preserve limited security, abuse, dispute, or legal records.

Account deletion does not automatically create a refund.

If a subscription remains active, you should cancel it through the billing process before requesting deletion.

Additional details may be provided on a separately published account-deletion page.

25. Privacy

HomeTunnel’s Privacy Policy explains how personal information is collected, used, disclosed, protected, retained, and deleted.

The Privacy Policy forms part of the overall service documentation but does not reduce mandatory privacy rights.

26. Software licence

Subject to your compliance with these Terms, HomeTunnel grants you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable licence to use HomeTunnel software solely for:

  • authorized personal use; or
  • authorized internal business use.

The licence applies only during the period in which you are authorized to use the relevant software or Service.

You must not, except where applicable law or an open-source licence expressly permits:

  • copy the software;
  • sell or distribute it;
  • lease or sublicense it;
  • modify it;
  • create derivative works;
  • decompile it;
  • disassemble it;
  • reverse engineer it;
  • extract source code;
  • circumvent technical restrictions; or
  • remove proprietary notices.

Nothing in these Terms overrides rights granted under an applicable open-source licence.

27. Intellectual property

HomeTunnel and its licensors retain all rights, title, and interest in:

  • the HomeTunnel Services;
  • software;
  • documentation;
  • website;
  • designs;
  • interfaces;
  • branding;
  • trademarks;
  • service marks;
  • trade names;
  • logos; and
  • other HomeTunnel materials.

These Terms do not grant permission to use HomeTunnel branding except as reasonably necessary to identify and use the Services.

Feedback you voluntarily provide may be used by HomeTunnel without restriction or compensation, provided HomeTunnel does not publicly identify you without permission.

28. Your information and configuration

You retain your rights in information and configuration you provide.

You grant HomeTunnel a limited right to host, process, transmit, reproduce, modify, and use that information only as reasonably necessary to:

  • provide the Services;
  • configure connectivity;
  • secure accounts and networks;
  • administer subscriptions;
  • provide support;
  • maintain and improve reliability;
  • comply with law;
  • enforce these Terms; and
  • establish or defend legal claims.

You represent that you have the rights and authority necessary for HomeTunnel to process information relating to any home, property, network, device, or person you configure.

29. Third-party services

The Services rely on or interact with third-party services such as:

  • Microsoft Entra;
  • Microsoft Azure Communication Services;
  • NetBird;
  • Paddle;
  • Cloudflare;
  • infrastructure and hosting providers;
  • Home Assistant;
  • internet service providers;
  • operating systems;
  • device manufacturers; and
  • network equipment.

Third-party terms and privacy policies may apply.

HomeTunnel is not responsible for an independent third party’s acts, omissions, service changes, security incidents, or outages except to the extent responsibility cannot legally be excluded.

30. Home Assistant and non-affiliation

Home Assistant is operated independently from HomeTunnel.

Unless HomeTunnel expressly states otherwise:

  • HomeTunnel is not affiliated with or endorsed by the Open Home Foundation;
  • HomeTunnel is not affiliated with or endorsed by Nabu Casa;
  • HomeTunnel is not an official Home Assistant service;
  • HomeTunnel is not affiliated with or endorsed by NetBird, Microsoft, Apple, Google, Paddle, Cloudflare, or other third-party providers; and
  • references to third-party names are for identification or interoperability purposes.

31. Updates

HomeTunnel may provide updates, fixes, security patches, compatibility changes, and new versions.

You may be required to install an update to continue using a software component.

HomeTunnel may stop supporting an outdated version where necessary for:

  • security;
  • compatibility;
  • provider requirements;
  • reliability;
  • legal compliance; or
  • reasonable product lifecycle management.

Failure to install required updates may cause some or all functionality to stop working.

32. Changes to the Services

HomeTunnel may modify, replace, suspend, or discontinue part of the Services for:

  • security;
  • legal compliance;
  • provider changes;
  • technical requirements;
  • reliability;
  • abuse prevention;
  • product development; or
  • commercial reasons.

HomeTunnel will provide reasonable notice where a material change adversely affects an active paid subscription, unless immediate action is required for security, law, provider failure, or prevention of harm.

Mandatory consumer rights remain unaffected.

33. Suspension and termination

HomeTunnel may suspend or terminate access if:

  • you materially breach these Terms;
  • you fail to pay;
  • you engage in fraud;
  • you initiate abusive or fraudulent payment disputes;
  • you access systems without authorization;
  • you create a security risk;
  • you violate applicable law;
  • you violate sanctions or export controls;
  • your activity threatens HomeTunnel, another user, a third party, or infrastructure;
  • suspension is required by a provider or authority; or
  • continued service creates an unreasonable legal or operational risk.

Where reasonably appropriate, HomeTunnel may provide notice and an opportunity to correct the breach.

HomeTunnel may act immediately where delay could increase:

  • unauthorized access;
  • security harm;
  • legal exposure;
  • fraud;
  • privacy harm;
  • infrastructure damage; or
  • harm to another person.

Termination ends the licence granted under these Terms.

Termination does not remove obligations or rights that accrued before termination.

34. Customer-caused risks

To the fullest extent permitted by law, HomeTunnel is not responsible for loss to the extent caused by:

  • phishing or social engineering directed at you;
  • compromise of your Microsoft or email account;
  • your disclosure of credentials or pairing information;
  • access you or another authorized manager approved;
  • failure to revoke a lost, sold, transferred, or compromised device;
  • malware on a system under your control;
  • rooting, jailbreaking, or disabling platform security;
  • an incorrect or unsafe route you configured;
  • an unauthorized target you supplied;
  • an unsafe Home Assistant automation;
  • failure of local equipment;
  • failure of internet or power;
  • unsupported network configuration;
  • misuse contrary to these Terms or documentation; or
  • unlawful or unauthorized use.

HomeTunnel is not an insurer of your property, network, equipment, data, or home.

You are responsible for determining whether the Services are suitable for your intended use and for maintaining safeguards appropriate to the consequences of failure.

35. Disclaimers

To the fullest extent permitted by law, the Services are provided “as is” and “as available.”

HomeTunnel disclaims implied warranties and conditions of:

  • merchantability;
  • fitness for a particular purpose;
  • title;
  • non-infringement;
  • uninterrupted availability;
  • error-free operation; and
  • compatibility,

but only to the extent those warranties or conditions may legally be excluded.

HomeTunnel does not warrant that:

  • every intrusion will be prevented;
  • every configuration error will be detected;
  • every device will remain connected;
  • every route will remain available;
  • all traffic will use a direct connection;
  • no data will ever be lost;
  • no third-party service will fail; or
  • the Services will satisfy life-safety, emergency, security-system, or regulatory requirements.

Mandatory consumer warranties and statutory rights remain unaffected.

36. Limitation of liability

To the fullest extent permitted by law, HomeTunnel and its directors, officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including loss of:

  • profit;
  • revenue;
  • business;
  • opportunity;
  • goodwill;
  • anticipated savings;
  • use;
  • data; or
  • remote access.

To the fullest extent permitted by law, HomeTunnel’s total aggregate liability arising from or relating to the Services or these Terms will not exceed the greater of:

  1. the HomeTunnel subscription fees paid or payable for your account during the 12 months immediately before the event giving rise to the claim; and
  2. CAD $100.

The exclusions and limitations above do not apply to liability that cannot legally be excluded or limited, including where applicable:

  • fraud;
  • fraudulent misrepresentation;
  • wilful misconduct;
  • gross negligence where it cannot be limited;
  • death or personal injury caused by negligence;
  • breach of privacy or security law where liability cannot be limited; or
  • mandatory consumer remedies.

Where both parties contributed to a loss, HomeTunnel is responsible only for the portion legally attributable to HomeTunnel.

37. Business indemnity

If you use the Services for business purposes, or engage in intentional or unlawful misuse, you will indemnify and defend HomeTunnel against third-party claims, liabilities, damages, and reasonable legal costs directly caused by:

  • your unauthorized access to a system;
  • your unlawful monitoring or surveillance;
  • your violation of another person’s rights;
  • an unauthorized property, device, network, or route you configured;
  • your infringement of intellectual-property rights;
  • your intentional misuse; or
  • your material breach of these Terms.

This indemnity does not apply to the extent a claim was caused by HomeTunnel’s own breach, negligence, misconduct, or violation of law.

For consumers, this section applies only to the extent permitted by mandatory law.

38. Export controls and sanctions

You must not use, export, re-export, transfer, provide, or make the Services available in violation of:

  • Canadian export controls;
  • United States export controls;
  • economic sanctions;
  • encryption controls;
  • telecommunications restrictions; or
  • applicable technology-transfer laws.

HomeTunnel may refuse or restrict service where reasonably necessary for compliance.

39. Governing law

These Terms are governed by the laws of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles.

Subject to mandatory consumer law, the courts located in Toronto, Ontario have exclusive jurisdiction over disputes relating to these Terms or the Services.

Consumers retain any mandatory right to bring a claim in another competent court where applicable law does not permit that right to be waived.

40. Informal dispute resolution

Before beginning formal proceedings, you and HomeTunnel agree to make a reasonable good-faith effort to resolve the dispute.

Contact:

legal@hometunnel.io

Include:

  • your name;
  • the email associated with the account;
  • a description of the dispute;
  • relevant dates;
  • the resolution requested; and
  • supporting information that does not expose credentials or security secrets.

Nothing in this section prevents:

  • a small-claims proceeding;
  • an urgent injunction;
  • a security response;
  • a regulatory complaint; or
  • another remedy that cannot legally be delayed or waived.

These Terms do not require arbitration and do not waive participation in a class proceeding where such a waiver would otherwise apply.

41. Changes to these Terms

HomeTunnel may update these Terms to reflect changes in:

  • the Services;
  • pricing or plans;
  • providers;
  • law;
  • security requirements;
  • technology; or
  • business operations.

The updated Terms will be posted with a revised effective date.

HomeTunnel will provide advance notice or request renewed acceptance where required for a material change.

Changes do not retroactively remove rights or remedies that already accrued.

42. General terms

Entire agreement

These Terms, the Privacy Policy, the Refund Policy, checkout disclosures, and any additional terms expressly accepted by you form the agreement concerning the Services.

Order of precedence

If documents conflict, the following order generally applies:

  1. mandatory law;
  2. transaction-specific checkout disclosures;
  3. applicable supplementary written terms;
  4. these Terms;
  5. the Privacy Policy and Refund Policy for their respective subject matter; and
  6. general website descriptions.

Severability

If part of these Terms is found unenforceable, it will be modified only to the minimum extent necessary, and the remaining provisions will continue.

No waiver

Failure to enforce a provision is not a waiver.

Assignment

You may not assign your account or these Terms without HomeTunnel’s written permission.

HomeTunnel may assign these Terms in connection with a merger, restructuring, financing, sale of assets, or transfer of the Services, subject to applicable law.

No partnership

These Terms do not create a partnership, joint venture, employment, fiduciary, franchise, or agency relationship between you and HomeTunnel.

Electronic communications

You consent to receive contractual, billing, security, account, and service communications electronically.

Survival

Provisions concerning payment, intellectual property, privacy, disclaimers, liability, indemnification, disputes, and other provisions that by their nature should survive will remain effective after termination.
